This possibility brings human germline editing into the focus of ethical and legal debates again.Main bodyAgainst this background, we explore essential ethical and legal questions of interventions into the human germline by means of CRISPR-Cas: How should issues of risk and uncertainty be handled? What responsibilities arise regarding future generations? Under which conditions can germline editing measures be therapeutically legitimized? For this (...) purpose, we refer to a scenario anticipating potential further development in CRISPR-Cas technology implying improved accuracy and exclusion of germline transmission to future generations. We show that, if certain concepts regarding germline editing are clarified, under such conditions a categorical prohibition of one-generation germline editing of single-cell embryos appears not to be ethically or legally justifiable.ConclusionThese findings are important prerequisites for the international debate on the ethical and legal justification of germline interventions in the human embryo as well as for the harmonization of international legal standards. Recent results from studies on animals suggest that functional germ cells may be generated from human pluripotent stem cells, giving rise to three possibilities: research with these so‐called artificial gametes, including fertilization experiments in vitro; their use in vivo for therapy for the treatment of human infertility; and their use in assisted reproductive technologies in vitro. While the legal, philosophical, and ethical questions associated with these possibilities have been already discussed intensively in other countries, the debate in Germany is still (...) at its beginning. A systematic and detailed analysis of the legal framework in Germany is provided with regard to the three possibilities, including the applicable statutory laws as well as the constitutional law. The question emerges as to whether the statutory laws as well as the constitution justify a distinction to be made between embryos of artificial and natural origin. This question is subject to philosophical analysis, discussing the distinction between person and thing, dignity and price, personality and property, and nature and technique. As a result, the criterion of naturalness alone may not be sufficient to differentiate between embryos of natural and artificial origin, and other criteria need to be identified. (shrink)

Innovative techniques of developmental biology facilitate the artificial creation of embryo-like entities. This contribution analyses, first, whether certain artificially created embryo-like entities are ‘embryos’ within the meaning of existing statutory law definitions laid down in the Embryo Protection Act, the Stem Cell Act and the Patent Act. These definitions are non-uniform and their interpretation and application with regard to artificially created embryo-like entities is not always conclusive. Accordingly, the legal definitions of the term ‘embryo’ should be harmonised and, thereby, adapted (...) to the state of developmental biology. Any such legislative efforts need to be in conformity with the constitution, primarily with the guarantee of human dignity (Article 1(1) of the Basic Law). However, said provision cannot provide guidance to the legislature because the constitutional status of both embryos and embryo-like entities in vitro is highly disputed. It is held that this irresolvable debate is due to a fundamental lack of a widely shared experience that such entities possess a supreme unique value. This article argues that in such a situation it is, in the first instance, for the legislature (i. e. parliament) to determine the legal status of embryos and embryo-like entities in vitro. This argument is based on a particular doctrinal approach according to which the individual right to respect of one’s human dignity arising from Article 1(1) BL depends on recognition of the relevant entity as being a ‘human’ or a member of ‘humankind’ respectively. Such recognition has, hitherto, not been accomplished with a view to embryos and embryo-like entities in vitro. Against this backdrop, for the time being, the legislature may determine the legal status of embryos and embryo-like entities in vitro, lay down rules regarding their creation and particular use, and, especially, define the legal term ‘embryo’, albeit within some outer constitutional limits. The article, finally, analyses several elements of, and submits a proposal for, a new legal definition of the term ‘embryo’. (shrink)

This book constitutes the outcome of an international conference held at the Otto-Mobes-Volkswirtschaftsschule, Graz-Stifting( Austria), from June 16 to 22, 1974. The conference was initiated by a project group working on determinants and controls of social science development at the In stitute for Advanced Studies and Scientific Research in Vienna and or ganized by the editors of this volume. It was held under the auspices of the Austrian Ministry of Science and Research. The main topics of the conference were those (...) at the forefront of the 'state of argumentation' (to borrow from one of our contributors) in philosophy and sociology of science ever since the controversy between Thomas S. Kuhn and Sir Karl R. Popper has sharpened our awareness for the methodological and substantial presuppositions involved with questions of growth and development in science. Let us give two examples of those topics. The borderline between sociology of science and philo sophy of science has become more and more unclear; while the work of at least some philosophers of science comes to have an empirical flavour, sociologists of science are increasingly apt to include logical and methodo logical components of the research process as their objects of examina tion. At the heart of our experience of literature is the idea that fiction can show us new possibilities for the world in which we live. I open up fictional worlds’ hermeneutic dimension by investigating the intersection of Roman Ingarden’s analytic phenomenology of the literary work with Hans-Georg Gadamer’s philosophical hermeneutics. Reading Ingarden together with Gadamer, I understand a fictional world as an orientation towards a fictional environment whose foundation is our capacity for language, showing how the reciprocal relationship (...) in which we discover its fictional objects and states of affairs is of the same kind that exists between language and world, so that fiction can be understood to orient us towards the happening of language. By thinking on the relationship between language and experience, I suggest that Ingarden and Gadamer propose to understand a fictional world as an orientation towards our very capacity to be otherwise and to exceed ourselves. Hermeneutics can be understood on the one hand as the art of interpretation, and on the other hand as a medium for dealing with the past, for conveying events, contexts or even writings in new ways of speaking for new recipients. The interpretation of writings, however, places special demands on hermeneutics: it does not take place in a sterile vacuum, but is rather embedded in a social and cultural context that shapes the interpretation or mediation and is an expression of (...) a time, a fashion or a specific requirement of modernity. The question therefore arises as to what role reason and experience, science and/or social ideas, tradition(s) and/or community play in interpretation. Using Thomas More's masterpiece Utopia as an example, various resulting interpretative approaches to a concrete writing will be presented. Through the hermeneutic design of a historical horizon in relation to Thomas More's time as well as through the development of a historical awareness of the work, the possibility of an understanding of this world-famous, still controversial writing as well as the efficiency of Gadamer's philosophical hermeneutics will become recognisable. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Neuroscience is a multidisciplinary effort to understand the structures and functions of the brain and brain-mind relations. This effort results in an increasing amount of data, generated by sophisticated technologies. However, these data enhance our descriptive knowledge, rather than improve our understanding of brain functions. This is caused by methodological gaps both within and between subdisciplines constituting neuroscience, and the atomistic approach that limits the study of macro- and mesoscopic issues. Whole-brain measurement technologies do not resolve these issues, but rather (...) aggravate them by the complexity problem. The present article is devoted to methodological and epistemic problems that obstruct the development of human neuroscience. We neither discuss ontological questions nor review data, except when it is necessary to demonstrate a methodological issue. As regards intradisciplinary methodological problems, we concentrate on those within neurobiology and psychology. As regards interdisciplinary problems, we suggest that core disciplines of neuroscience can be integrated using systemic concepts that also entail human-environment relations. We emphasize the necessity of a meta-discussion that should entail a closer cooperation with philosophy as a discipline of systematic reflection. The atomistic reduction should be complemented by the explicit consideration of the embodiedness of the brain and the embeddedness of humans. The discussion is aimed at the development of an explicit methodology of integrative human neuroscience, which will not only link different fields and levels, but also help in understanding clinical phenomena. The notion of horizonality plays an important role in hermeneutical philosophy above all owing to the centrality afforded the concept of horizon in Hans‐Georg Gadamer's groundbreaking Truth and Method. The notion of the horizon is explicitly introduced as a metaphor for the way that intellectual understanding mirrors everyday perceptions of visible objects in that they always and inevitably take place from a perspective that opens up a space within which some things can easily be seen but which also (...) sets the limits beyond which things cannot easily be seen without additional efforts or movement. Gadamer himself recognizes that the insights into the role of horizons in any understanding developed in the nineteenth century with the rise of historical consciousness in general and then came to be themes of explicit reflection in his own immediate philosophical predecessors, Dilthey, Husserl, and Heidegger. In this two-volume work of mystical theology, Gardeil explains the material cause of the experiential knowledge that comes from the gift of wisdom, which is one of the seven gifts of the Holy Spirit. La Structure is the third book in a trilogy that focuses on the supernatural knowledge of God, beginning with apologetics in La Crédibilité et l’apologétique (1st ed. 1908), and continuing with the nature of revelation in Le Donné révélé et la théologie (1st ed. 1910). In La Structure, Gardeil develops the thesis that there is an analogy between experiential self-knowledge and the mystical experiential knowledge of God. In the course of his inquiry, Gardeil touches upon philosophical and theological problems concerning self-knowledge, intentionality, the structure of the mind (mens), God’s indwelling in the souls of the just, and the relationship between faith and the gift of wisdom. De Belloy’s new volume is on Gardeil’s presentation of this analogy and its reception by his contemporaries.De Belloy considers largely the issues that surround self-knowledge, the structure of the soul, and mystical experience. He draws together material from Gardeil’s own sources, Gardeil’s contemporaries, and subsequent Thomistic scholarship. He sheds light on the issues themselves, the historical context, and different hermeneutical strategies in Thomism. According to De Belloy, this twentieth-century Thomistic and largely Dominican discussion is important for contemporary philosophers and theologians. De Belloy emphasizes the interaction between Gardeil and Roland-Gosselin, and at the end of his volume, includes their previously unpublished correspondence.Although De Belloy often notes the difficulty of reading Gardeil’s neo-Scholastic prose, it seems to me that the non-native French reader will find Gardeil more accessible than De Belloy, especially when the latter draws on writers such as Henri Bergson and Hans-Georg Gadamer. Moreover, De Belloy’s discussion is easier to follow if one has already read and is familiar with the four parts of Gardeil’s La Structure. In part 1, Gardeil addresses the structure of mind or spirit (mens), and in particular considers Augustine’s [End Page 472] three main, threefold divisions of the soul in De Trinitate (mens, notitia, amor; memoria [sui], intelligentia, voluntas; memoria [Dei], intelligentia, amor) and Aquinas’s own interpretation and appropriation of these divisions. In part 2, Gardeil describes the way in which sanctifying grace, a created quality that is distinct from the infused virtues, causes the soul’s conformity to God’s essence. In part 3, he discusses God’s presence within the souls of the just and agrees with previous Thomists that God is especially present to the just as an object of faith and love. In part 4, he applies the previous discussion to the structure of mystical knowledge. This last part is the culmination of the entire work, as it addresses the analogy between self-knowledge and the knowledge of God that was defended by earlier Dominican Thomists such as John of St. Thomas (1589–1644) and Thomas de Vallgornera (c. 1595–1665).Part... Dialectic is the parting of ways in philosophy. The analytical movement inaugurated by Moore and Russell took its departure in an attack against Neo‐Hegelianism in Britain, presenting analysis as the cure for the dialectical disease. Gadamer's contributions to Greek philosophy and, in particular, his readings of Plato, arguably the most significant thinker for Gadamerian hermeneutics. Hence, in Gadamer's hermeneutics, the dialectic of question and answer does not function as a maxim that one should apply in exegetic business instead of other (...) competing maxims or methods. Gadamer acknowledges a speculative dimension; but he finds this dimension in our everyday understanding, promoted by the web of ordinary language. This searching examination of the life and philosophy of the twentieth-century Indian intellectual Jarava Lal Mehta details, among other things, his engagement with the oeuvres of Martin Heidegger, Hans-Georg Gadamer, and Jacques Derrida. It shows how Mehta’s sense of cross-cultural philosophy and religious thought were affected by these engagements, and maps the two key contributions Mehta made to the sum of human ideas. First, Mehta outlined what the author dubs a ‘postcolonial hermeneutics’ that uses the ‘ethnotrope’ of the (...) pilgrim to challenge the philosophical hermeneutic emphasis on supplementation and augmentation. For Mehta, the hermeneutic encounter ruptures, rather than supplements, the self. Secondly, Mehta extended this concept of hermeneutics to interrogate the Hindu tradition, arriving at the concept of the ‘negative messianic’. In contrast to Derrida's emphasis on the 'one to come', Mehta shows how the Hindu bhakti model represents the very opposite, that is, the 'withdrawn other,' identifying thereby the ethical pitfalls of deconstructivism's emphasis on the messianic tradition. Recent scholarship on the nature of truth within Hans-Georg Gadamer’s and Martin Heidegger’s philosophies has focused primarily on identifying and explicating the commonality between their respective accounts of truth. However, this emphasis on commonality has overlooked Gadamer’s distinctive understanding of truth outside of and beyond a simple development of Heidegger’s consideration of truth as alētheia. This paper defends the claim that the specific manner in which Gadamer and Heidegger critique the correspondence theory of truth is indicative of their (...) distinctive conceptions of truth more generally. While Heidegger understands truth as the unconcealment of beings through the disclosure of Dasein as Being-in-the-world as such, Gadamer concludes that truth is the disclosure of human being through hermeneutical understanding as realized in concrete dialogical engagement in particular. These similar, but often conflicting, accounts of truth cannot be subsumed within one another without overlooking and thereby misunderstanding the philosophical insights found in Gadamer’s and Heidegger’s distinctive philosophies. More importantly, the inability or unwillingness to distinguish their conceptions of truth prevents any subsequent analysis of which thinker provides a more compelling critique of the correspondence theory of truth and which account is more plausible as an understanding of the phenomenon of truth broadly construed. This article takes its point of departure from the second (embodied) linguistic turn represented by the enactivist notion of humans as linguistic bodies, using resources from Hans Georg Gadamer in order to propose a view of the relation between art and everyday experience as one of symbolic transformation. Conceiving art as a form of linguistic phenomenon wherein one can engage in original situations of communication, this view rejects both autonomist and direct continuity views of the art-everyday relation. We (...) start by situating the idea of linguistic bodies within the enactive approach, spelling out relevant aspects concerning the significance of language for human life and perception (Sect. 2). Then we embark on a discussion of aspects of Shaun Gallagher’s and Alva Noë’s enactivist perspectives on art experience, highlighting places where their views align with and depart from ours (Sect. 3). The last two sections aim to lay out the transformative view in more detail, proposing a pluralistic understanding of art media and a view of art and art experience as modes of ideational, embodied thought (Sects. 4 and 5). We publish here the letters between Gadamer and Ricoeur, as they are found in the Archives of the two philosophers (Gadamer-Archiv in Marbach and Fonds Ricoeur in Paris). Starting from February 1964 and ending on October 2000, the thirty-five letters reproduced here cannot give a complete picture of their much richer correspondence and relations, because it seems that neither Ricoeur, nor Gadamer kept all the letters they received from one another. But altogether, they document their common concerns, their mutual respect, (...) even their intellectual solidarity and finally the particular context that brought them to write to one another, i.e. Ricoeur’s intention to publish a translation of Gadamer’s book, Truth and Method, in a new series he edited for the Seuil Publisher. 1.Summary The key terms. 1. Key term: ‘Sunyata’. Nagarjuna is known in the history of Buddhism mainly by his keyword ‘sunyata’. This word is translated into English by the word ‘emptiness’. The translation and the traditional interpretations create the impression that Nagarjuna declares the objects as empty or illusionary or not real or not existing. What is the assertion and concrete statement made by this interpretation? That nothing can be found, that there is nothing, that nothing exists? Was Nagarjuna denying (...) the external world? Did he wish to refute that which evidently is? Did he want to call into question the world in which we live? Did he wish to deny the presence of things that somehow arise? My first point is the refutation of this traditional translation and interpretation. 2. Key terms: ‘Dependence’ or ‘relational view’. My second point consists in a transcription of the keyword of ‘sunyata’ by the word ‘dependence’. This is something that Nagarjuna himself has done. Now Nagarjuna’s central view can be named ‘dependence of things’. Nagarjuna is not looking for a material or immaterial object which can be declared as a fundamental reality of this world. His fundamental reality is not an object. It is a relation between objects. This is a relational view of reality. This is the heart of Nagarjuna’s ideas. In the 19th century a more or less unknown Italian philosopher, Vincenzo Goberti, spoke about relations as the mean and as bonds between things. Later, in quantum physics and in the philosophy of Alfred North Whitehead we are talking about interactions and entanglements. These ideas of relatedness or connections or entanglements in Eastern and Western modes of thought are the main idea of this essay. Not all entanglements are known. Just two examples: the nature of quantum entanglements is not known. Quantum entanglements should be faster than light. That's why Albert Einstein had some doubts. A second example: the completely unknown connections between the mind and the brain. Other examples are mysterious like the connections between birds in a flock. Some are a little known like gravitational forces. 3. Key terms: ‘Arm in arm’. But Nagarjuna did not stop there. He was not content to repeat this discovery of relational reality. He went on one step further indicating that what is happening between two things. He gave indications to the space between two things. He realized that not the behaviour of bodies, but the behaviour of something between them may be essential for understanding the reality. This open space is not at all empty. It is full of energy. The open space is the middle between things. Things are going arm in arm. The middle might be considered as a force that bounds men to the world and it might be seen as well as a force of liberation. It might be seen as a bondage to the infinite space. 4. Key term: Philosophy. Nagarjuna, we are told, was a Buddhist philosopher. This statement is not wrong when we take the notion ‘philosophy’ in a deep sense as a love to wisdom, not as wisdom itself. Philosophy is a way to wisdom. Where this way has an end wisdom begins and philosophy is no more necessary. A.N. Whitehead gives philosophy the commission of descriptive generalization. We do not need necessarily a philosophical building of universal dimensions. Some steps of descriptive generalization might be enough in order to see and understand reality. There is another criterion of Nagarjuna’s philosophy. Not his keywords ‘sunyata’ and ‘pratityasamutpada’ but his 25 philosophical examples are the heart of his philosophy. His examples are images. They do not speak to rational and conceptual understanding. They speak to our eyes. Images, metaphors, allegories or symbolic examples have a freshness which rational ideas do not possess. Buddhist dharma and philosophy is a philosophy of allegories. This kind of philosophy is not completely new and unknown to European philosophy. Since Plato’s allegory of the cave it is already a little known. (Plato 424 – 348 Befor Current Era) The German philosopher Hans Blumenberg has underlined the importance of metaphors in European philosophy. 5. Key terms: Quantum Physics. Why quantum physics? European modes of thought had no idea of the space between two this. They were bound to the ideas of substance or subject, two main metaphysical traditions of European philosophical history, two main principles. These substances and these subjects are two immaterial bodies which were considered by traditional European metaphysics as lying, as a sort of core, inside the objects or underlying the empirical reality of our world. The first European scientist who saw with his inner eye the forces between two things had been Michael Faraday (1791-1867). Faraday was an English scientist who contributed to the fields of electromagnetism. Later physicists like Albert Einstein, Niels Bohr, Erwin Schrödinger, Werner Heisenberg and others followed his view in modern physics. This is a fifth point of my work. I compare Nagarjuna with European scientific modes of thought for a better understanding of Asia. I do not compare Nagarjuna with European philosophers like Hegel, Heidegger, Wittgenstein. The principles and metaphysical foundations of physical sciences are more representative for European modes of thought than the ideas of Hegel, Heidegger and Wittgenstein and they are more precise. And slowly we are beginning to understand these principles. Let me take as an example the interpretation of quantum entanglement by the British mathematician Roger Penrose. Penrose discusses in the year of 2000 the experiences of quantum entanglement where light is separated over a distance of 100 kilometers and still remains connected in an unknown way. These are well known experiments in the last 30 years. Very strange for European modes of thought. The light should be either separated or connected. That is the expectation most European modes of thought tell us. Aristotle had been the first. Aristotle (384 - 322 Before Current Era) was a Greek philosopher, a student of Plato and a teacher of Alexander the Great. He told us the following principle as a metaphysical foundation: Either a situation exists or not. There is not a third possibility. Now listen to Roger Penrose: “Quantum entanglement is a very strange type of thing. It is somewhere between objects being separate and being in communication with each other” (Roger Penrose, The Large, the Small and the Human Mind, Cambridge University Press. 2000 page 66). This sentence of Roger Penrose is a first step of a philosophical generalization in a Whiteheadian sense. 6. Key terms: ‘The metaphysical foundations of modern science’ had been examined particularly by three European and American philosophers: E. A. Burtt, A.N. Whitehead and Hans-Georg Gadamer, by Gadamer eminently in his late writings on Heraclitus and Parmenides. I try to follow the approaches of these philosophers of relational views and of anti-substantialism. By ‘metaphysical foundations’ Edwin Arthur Burtt does not understand transcendental ideas but simply the principles that are underlying sciences. -/- 7. Key terms: ‘Complementarity’, ‘interactions’, ‘entanglements’. Since 1927 quantum physics has three key terms which give an indication to the fundamental physical reality: Complementarity, interactions and entanglement. These three notions are akin to Nagarjuna’s relational view of reality. They are akin and they are very precise, so that Buddhism might learn something from these descriptions and quantum physicists might learn from Nagarjuna’s examples and views of reality. They might learn to do a first step in a philosophical generalisation of quantum physical experiments. All of us we might learn how objects are entangled or going arm in arm. In recent years, there has been an intense debate about the concept of “biological” or “genetic citizenship.” The growing literature on this topic mostly refers to the importance of patients’ associations, disease advocacy organizations, and self-help groups that are giving rise to new forms of subjectivation and collective action. The focus is on the extension of rights, the emergence of new possibilities of participation, and the choice-enhancing options of the new genetics. We aim to broaden and complement the existing theoretical discussion on biological citizenship, which so far has concentrated on the medical sphere, by investigating a new empirical field. The article analyzes the use of DNA analysis for family reunification and shows that biological criteria still play an important role in decision making on citizenship rights in nation-states. Presenting Germany as an exemplary case, we argue that the use of parental testing endorses a biological concept of the family that is mobilized to diminish citizenship rights. The argument is based on documentary analysis and on interviews with representatives of nongovernmental organizations and immigration authorities, lawyers, geneticists, and applicants for family reunification. A wide-ranging collection of philosophical essays in honor of Hans-Georg Gadamer.

English summary: Gadamer's main work, Truth and Method, will be published in 2010, exactly 50 years after the first edition, in a slightly corrected version as an inexpensive student edition. This is seen as one of the few standard works of German post-war philosophy which has achieved worldwide recognition. The huge reaction to this is surprising for many reasons, among other things because in this work an important new theory is presented in intimations only using the author's own conceptual instruments; (...) in fact the author is careful when touching on ancient themes in the philosophical approach to the world. The main question in the work is: What actually happens when we understand? Gadamer focuses on the historical dimensions of understanding, including his famous rehabilitation of prejudice. In addition to the systematic excursus, the book contains an intellectual history of hermeneutics, which is convincing in its virtuosity in dealing with a variety of inspirational figures such as Hegel, Dilthey, Husserl and Heidegger. The amiability and objectivity with which Gadamer invites his readers to a discussion are what account for the enormous influence of this exemplary textbook.
